Litigation for professional malpractice has been on the increase for a number of years. This was initially seen across the Atlantic – but it is a well known fact that anything that occurs in the USA will be transferred to the UK some 5-10 years later. Consequently, a substantial increase in litigation is now seen in the UK, which is reflected in medical insurance/professional indemnity premiums charged by insurance companies.
Optometry has not seen the same increase in litigation as the medical profession. As the public knowledge, awareness, and expectations increase, any treatment which is considered to be below standard may, and increasingly is, litigated upon.
